HB335 Summary

• Amends Section 41-16-57, Code of Alabama 1975, to change the maximum contract term for residential solid waste collection and disposal from three years to five years.

• Allows awarding authorities to award contracts to the second lowest responsible bidder if the lowest bidder defaults or notifies in writing they will no longer comply with the original award terms, provided the second lowest bid is at the same or lower price.

• Establishes requirements for sole source specifications, including documentation that goods or services are indispensable, all viable alternatives have been explored, and no other vendor offers substantially equivalent goods or services.

• Permits awarding authorities to determine lowest responsible bids using life cycle costs for personal property purchases when total cost of ownership can be reasonably ascertained from industry-recognized sources.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
