Proposes a local constitutional amendment for Shelby County to bring certain privately owned sewer systems under Public Service Commission jurisdiction and regulation.

Applies to private sewer systems that use public rights-of-way of public roads, discharge to Grade III or higher wastewater treatment facilities, and have residential or commercial customers billed by flat fee or water usage.

Public Service Commission shall certify and regulate affected utilities, including regulation of rates, charges, and rate increases in accordance with Title 37, Code of Alabama 1975.

Allows counties, municipalities, or governmental utility service corporations to opt out of Public Service Commission regulation if they have executed a rate control agreement with the sewer system as of or prior to January 1, 2021.

If a rate control agreement becomes invalid, terminated, or unenforceable, Public Service Commission jurisdiction is automatically restored, and the entity cannot opt out again for five years.
