• Prohibits any holder of an alcoholic beverage license or permit from selling, distributing, marketing, delivering, or displaying drug paraphernalia or non-conforming pharmaceuticals.

• On first violation, the Alcoholic Beverages Control Board, local officials, or law enforcement must provide written or verbal notification requiring immediate cessation of sales and removal of prohibited items within 24 hours.

• On second or subsequent violations, a rebuttable presumption exists that the licensee knowingly violated the prohibition.

• Defines "drug paraphernalia" as items displayed or promoted in a manner suggesting usefulness for growing, processing, or ingesting marijuana, hashish, cocaine, or controlled substances under federal law or Alabama Code Section 13A-12-212.

• Violations of this prohibition constitute a misdemeanor punishable by a fine of $100-$1,000 with possible imprisonment; penalties increase for subsequent convictions.
