HB446 Summary

• Prohibits governmental entities from adopting or enforcing policies that ban persons or entities from using utility services from any provider authorized to do business in Alabama.

• Applies to utility energy services including electricity, natural gas, fuel oil, propane, methane, and ethanol in retail or wholesale form.

• Allows governmental entities to continue exercising police powers for building permits, fire and safety codes, and licensing of utility providers, but prohibits denials based solely on the type of utility service proposed.

• Exempts utilities and utility systems established and operated by municipalities under Chapter 50 of Title 11 from the act's restrictions.

• Does not affect rules of the Alabama Public Service Commission or Chapter 14 of Title 37, Code of Alabama 1975.
