HB605 Summary

• Adds Section 22-51-15 to the Code of Alabama 1975 to provide immunity protections for regional mental health programs and their directors and employees.

• Directors and employees of regional mental health entities are entitled to the same immunity as state employees under Section 36-1-12 when performing services certified and contracted by the Alabama Department of Mental Health.

• Supersedes previous protections limiting damages available under Article 8 of Chapter 47 of Title 11 and Chapter 93 of Title 11.

• Immunity protections do not extend to subcontractors or independent contractors of the regional mental health programs and facilities.

• Applies only to claims accruing on or after the effective date and becomes effective on the first day of the third month following passage and approval.
