HB611 Summary

• Prohibits drivers from using wireless devices to write, send, or read text-based communications; watching, viewing, recording, or capturing photographs or videos; physically holding a wireless device; or engaging in handheld voice-based communications while operating a motor vehicle on public roads.

• Establishes exceptions including emergency calls, parked vehicles, GPS navigation (without manual input while driving), hands-free voice communications, dash cameras, utility workers and first responders on duty, and certain mounted device use for adults 18 and older.

• Creates graduated penalties: $100 fine for first violation, $200 for second violation, and $300 for third or subsequent violations, with no court costs imposed solely for these violations.

• Establishes driving record points: first and second convictions result in 2-point violations; third and subsequent convictions result in 3-point violations.

• Becomes effective on the first day of the third month following passage and approval by the Governor; requires state, county, and municipal law enforcement agencies to maintain statistical information on traffic stops including data on stops involving minority groups.
