HB74 Summary

• Amends Sections 12-18-10 and 12-18-61 of the Alabama Code to revise compensation for retired justices and judges called to interim active duty status.

• Establishes that retired appellate justices or judges called to interim active duty shall receive additional compensation not to exceed 25 percent of the actual salary of an active court of appeals justice or judge with 20 or more years of service.

• Requires retired circuit judges and district judges called to interim active duty to receive additional compensation not to exceed 25 percent of the actual salary of an active circuit or district judge with 20 or more years of service, subject to available funding.

• Adds certification requirements for calling retired circuit and district judges to interim active duty, including presiding judge request, Chief Justice and Administrative Office of Courts certification of need based on judicial weighted caseload study, and annual re-certification.

• Makes technical and stylistic updates to existing code language and becomes effective on the first day of the third month following passage and approval by the Governor.
