HB80 Summary

• Amends Section 36-21-2 of Alabama Code to add law enforcement officers assigned to the Investigations Division of the Department of Revenue and Department of Mental Health to the list of officers receiving subsistence pay.

• Provides a subsistence allowance of $12 per working day for each officer engaged in law enforcement duties for four or more hours within a consecutive 24-hour period, effective October 1, 2019.

• Subsistence allowance is tax-exempt and provided in addition to all other compensation, expenses, and allowances.

• Applies retroactively to October 1, 2019, for employees in good standing as of the effective date, including payments made between October 1, 2019, and February 1, 2020.

• Became effective immediately upon passage and approval by the Governor in April 2021.
