HB91 Summary

• Applies exclusively to Class 5 municipalities with a mayor/commission/city manager form of government and authorizes abatement of overgrown grass or weeds exceeding 12 inches in height that pose public health, safety, fire, or aesthetic hazards.

• Excludes heavily wooded undeveloped areas, farm properties, and properties under current construction from nuisance requirements.

• Establishes a notice and hearing process requiring enforcing officials to provide written notice to property owners with 10 to 28 days to abate the nuisance and allowing property owners to request administrative hearings to appeal determinations.

• Permits municipalities to perform abatement work and assess costs against property owners, which are collected through addition to ad valorem tax bills by county tax collecting officials and subject to foreclosure procedures if delinquent.

• Creates a "weed lien" on property that is subordinate to mortgages or security interests recorded prior to the lien's recordation and survives redemptions or state sales.
