SB140 Summary

• Creates the Self-Service Storage Facilities Act, establishing comprehensive regulations for self-service storage facilities including definitions, operator liens, and procedures for default enforcement.

• Grants operators a lien on stored personal property for delinquent rent, late fees, labor, and other charges, superior to all liens except tax liens, that attaches when property is placed in the leased space.

• Allows operators to deny access to defaulted units and conduct sales of stored property after more than 30 days of default, requiring 20 days' notice to occupants and lienholders by verified mail or electronic mail.

• Requires operators to publish sale advertisements at least 7 days before sale in local newspapers or through commercially reasonable methods, with sales conducted publicly or privately provided they are commercially reasonable.

• Permits monthly late fees of $20 or 20 percent of monthly rental amount, whichever is greater, and allows operators to tow vehicles, watercraft, or trailers after 60 days of unpaid charges; effective October 1, 2021.
