SB144 Summary

• Amends Section 20-1-6 of the Code of Alabama 1975 to provide immunity from criminal and civil liability for good faith donors of canned or perishable food that is apparently fit for human consumption at the time of donation.

• Extends immunity to bona fide charitable or nonprofit organizations that in good faith receive and distribute food without charge, unless injury or death results from gross negligence, recklessness, or intentional misconduct.

• Explicitly includes meat from game animals in the definition of perishable food covered by the immunity provisions.

• Preserves the authority of appropriate agencies to regulate or ban the use of such food for human consumption.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
