SB167 Summary

• Adds Section 28-3A-20.4 to Alabama Code authorizing wine festival licenses issued by the Alcoholic Beverage Control Board upon application at least 25 days in advance with a fee not to exceed $50.

• Wine festival licenses may be issued to wine manufacturers producing at least 500 gallons annually, retailers, grape grower organizations, municipalities, counties, or incorporated arts/downtown development entities to host festivals lasting no more than 5 consecutive days.

• Wine festival participant licenses (fee not to exceed $15) authorize retailers and qualifying wine manufacturers to dispense tastings and sell wine for on-premises or off-premises consumption, limited to one case (12 750-milliliter bottles) per individual per festival.

• Off-premises wine sales must be sealed, labeled, and packaged per local, state, and federal law, with all applicable taxes collected and remitted by participants.

• Wine festival licenses are free if held entirely on premises of the hosting winery; Sunday sales prohibited in counties/municipalities that have not authorized Sunday alcohol sales.
