SB17 Summary

• Allows nonprofit corporations organized under Alabama law that provide water service to the public to be audited or examined by the Department of Examiners of Public Accounts, beginning after the close of the current fiscal year and every two years thereafter.

• The Department of Examiners of Public Accounts may conduct audits in the same manner as provided in Chapter 5A of Title 41, Code of Alabama 1975, and may charge a reasonable fee for the audits.

• Exempts public water supply systems, waterworks plants, and water distribution systems owned or operated by municipalities or public entities incorporated pursuant to Title 11 of the Code of Alabama 1975 from this requirement.

• Applies only to nonprofit corporations not incorporated pursuant to Title 11, Code of Alabama 1975.

• Effective immediately upon passage and approval by the Governor.
