SB246 Summary

• Proposes a constitutional amendment applicable only to Etowah County prohibiting commencement of operations at certain animal byproduct processing facilities within 10 miles of any municipality's corporate limits, effective retroactively to January 1, 2021.

• Defines "subject facility" as an animal byproduct processing facility whose owner(s) have been assessed $50,000,000 or more in federal law or regulation violation fines since January 1, 2000; includes rendering facilities but excludes slaughterhouses, deer processing facilities, and butcher shops.

• "Commencement of operations" includes surveying, construction, demolition, renovation, equipment installation or repurposing, and processing or production operations on the property.

• Election on the proposed amendment shall be held at the 2022 primary election in accordance with Alabama Constitution Section 284.01 and state election laws.

• Election officials shall assign a ballot number and include the amendment description with "Yes" and "No" voting options on the ballot.
