SB248 Summary

• Eliminates civil liability for contractors performing road, bridge, or street work that complies with contract specifications but creates a dangerous condition that should have appeared defective to a reasonably prudent contractor.

• Removes the requirement that contractors must notify the awarding authority of potentially dangerous conditions arising from following contract specifications in order to gain immunity from civil liability.

• Provides contractors with civil immunity once the Alabama Department of Transportation or awarding authority determines that the contractor's work substantially complies with the plans and specifications and accepts the project.

• Amends Code of Alabama 1975 Sections 6-5-701, 6-5-702, and 6-5-703 to consolidate and simplify civil liability protections for public works contractors.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
