SB268 Summary

• Amends Section 34-25A-3 of the Code of Alabama 1975 to further define "orthosis" under the Prosthetics and Orthotics Act.

• Adds definition that a custom-fitted orthosis is an orthotic device required to be assembled or modified by a licensed person for a specific patient to achieve proper fit, comfort, and function.

• Clarifies that off-the-shelf orthotic devices are manufactured as commercially available items for any patient and can be self-adjusting without requiring assembly or modification for a specific patient.

• Excludes from the definition of orthosis items such as prefabricated devices, adaptive equipment, splints, corsets, arch supports, elastic supports, braces, crutches, and similar devices commonly stocked by pharmacies or surgical supply facilities.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
