SB307 Summary

• Requires health care facilities to allow patients to receive visitors during declared public health emergencies, consistent with applicable federal laws and regulations from Centers for Medicare and Medicaid Services or Centers for Disease Control and Prevention.

• Permits health care facilities to require visitors to comply with reasonable safety protocols and allows restrictions on caregivers or visitor advocates based on uncontrollable infectious disease exposure, exhibiting infectious disease symptoms, or lack of adherence to infection control practices.

• Applies to general acute care hospitals, long-term care facilities, skilled nursing facilities, intermediate care facilities, assisted living facilities, and specialty care assisted living facilities.

• Prohibits visitation restrictions based on race, color, national origin, religion, sex, gender identity, sexual orientation, or disability, and requires facilities to notify patients of their visitation rights and any clinical restrictions.

• Grants civil immunity to health care facilities acting in good faith compliance with the law and does not expand or alter Centers for Medicare and Medicaid Services visitation guidelines.
