SB322 Summary

• Amends Section 28-3A-6, Code of Alabama 1975, relating to manufacturer licenses for alcoholic beverages and retail sales.

• Beer transferred between breweries of the same ownership (at least 75% owned or controlled by the other) in accordance with federal law is deemed manufactured by the receiving brewery at its licensed premises.

• When calculating whether a brewery produces less than 60,000 barrels annually, only beer provided by a contract brewery that is produced exclusively for that brewery shall be counted toward the limit.

• Maintains existing provisions allowing breweries producing less than 60,000 barrels per year to sell beer at retail on-premises and off-premises (limited to 288 ounces per customer per day) without contract brewery restrictions.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
