SB4 Summary

• Amends Section 32-5A-176.1 of the Alabama Code to classify construction zone violations as moving violations when construction or maintenance workers are present and work zone traffic control devices or warning signs are in place.

• Establishes penalties of the greater of $250 or double the standard fine prescribed by law for construction zone moving violations, with doubled fines applicable only when construction personnel are present and indicated by signs.

• Authorizes the State Department of Transportation to set speed limits in construction zones on state and interstate highways, and county commissions to set speed limits on county roads or highways, with limits posted at least 100 feet before the construction zone entrance.

• Eliminates additional court costs for persons convicted under this section and requires fines collected to be distributed as other moving violation fines are distributed under state law.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
