SB49 Summary

• Authorizes counties, municipalities, and districts or authorities incorporated under Title 11 of the Alabama Code to use public funds to repair or replace private sewer laterals that threaten public health.

• Requires property owners requesting repairs to certify financial inability to pay, and allows the government entity to recover actual repair costs by prorating charges on the owner's utility bill with terms mutually agreed upon.

• Defines "private sewer lateral" as a sewer line on private property connecting to a public sewer system, excluding any portion within a building's foundation.

• Requires the government entity to restore the property to its original condition after repairs and prohibits them from becoming the owner of the lateral or assuming additional duties unless they adopt a resolution accepting such duties.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
