SB57 Summary

• Amends Section 18-3-1 of the Code of Alabama 1975 to allow landowners with no adjacent public road access to acquire a right-of-way not exceeding 30 feet in width over intervening lands to reach the nearest public road.

• Requires landowners within municipalities to obtain written approval from the municipal government and planning board prior to filing an application for a right-of-way.

• Allows probate courts to grant rights-of-way over public unused lands managed by the Department of Conservation and Natural Resources, provided the right-of-way does not substantially impair future planned development and receives State Lands Division approval.

• Excludes land subject to the Forever Wild Land Trust or sixteenth section land from the provisions allowing rights-of-way over public unused lands.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or upon becoming law otherwise; passed by the Senate 29-0 on March 1, 2021.
