SB60 Summary

• Amends Section 39-2-2 of the Alabama Code to expand the exemption from public works bidding requirements for heating and air conditioning unit purchases by government entities.

• Allows government entities to purchase heating or air conditioning units or systems without sealed bids if purchased through an Alabama vendor with approved vendor status in a purchasing cooperative, provided the competitive bid process was approved by the Department of Examiners of Public Accounts.

• Requires that heating or air conditioning purchases through the cooperative be priced equal to or less than state purchasing program prices and that vendors provide sales reports upon request.

• Clarifies that the exemption from sealed bid requirements does not exempt heating or air conditioning projects from compliance with design, installation, review requirements, applicable codes, laws, specifications, standards, and compensation of engineers or architects as mandated by state law.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
