SB76 Summary

• Authorizes wireless providers to collocate, mount, or install small wireless facilities on existing poles or install new poles on state and local rights-of-way as a permitted use, subject to nondiscriminatory requirements.

• Exempts small wireless facilities located in rights-of-way from zoning review and approval procedures if they comply with the act and FCC requirements.

• Establishes application processing deadlines of 60 days for collocation on existing structures and 90 days for new or replacement poles, with automatic approval if authorities fail to act within 20 days of formal notice.

• Sets nondiscriminatory fee caps: $500 for collocation applications (plus $100 per facility over five), $250 for pole modification with facility installation, $1,000 for new pole installation, and annual use fees not to exceed $100 per facility for right-of-way access and $170 per facility for pole collocation.

• Excludes electric provider poles from the act's requirements and does not apply to authorities with pre-existing wireless facility agreements, ordinances, or resolutions adopted before May 1, 2021.
