SB83 Summary

• Amends Section 16-64-2 of the Alabama Code to establish resident student tuition status for minor children of military service members on full-time active duty stationed in Alabama under orders for duties other than attending school.

• A minor student establishing residency through a military parent retains resident student status regardless of any out-of-state transfer of the military member, provided the student maintains continuous enrollment at the institution.

• Requires Alabama public institutions of higher education to consider military service members stationed in Alabama, their spouses, and minor children as resident students for tuition purposes regardless of whether the military member is under orders to attend schooling.

• Boards of trustees at each public institution must adopt rules and guidelines to implement these provisions.

• Takes effect on the first day of the third month following passage and approval by the Governor.
