SJR46 Summary

• Establishes the Study Commission on Pre-Trial Services and Alternative Courts to examine entrance processes, costs, indigency availability, effectiveness, and uniformity of pre-trial diversion and alternative court programs in Alabama.

• Commission composition includes 13 members: Executive Director of Alabama Sentencing Commission (Chair), 2 House members, 2 Senate members, 1 each from Senate and House minority leadership, 2 circuit court judges, 1 district attorney, 1 attorney, 2 legal research organization representatives, and 1 county commission representative.

• Appointing authorities must coordinate appointments to ensure the commission reflects Alabama's racial, gender, geographical, urban, rural, and economic diversity.

• Commission must hold initial meeting by September 1, 2021, with appointments indicated to the Alabama Sentencing Commission Executive Director by the first day of the third month following gubernatorial signature.

• Commission shall submit findings and recommendations to the Senate President Pro Tempore and House Speaker by the first day of the 2022 Legislative Session, at which time it shall be dissolved.
