HB2 Summary

• Establishes mandatory supervised release for inmates sentenced to 5 years or less (3-5 months prior to release), more than 5 years but less than 10 years (6-9 months prior), and 10 years or more (10-12 months prior), excluding sex offenders involving children.

• Requires all inmates released under these provisions to be subject to electronic monitoring for a period determined by the director, with the Board of Pardons and Paroles responsible for monitoring costs.

• Adds electronic monitoring as a mandatory parole condition and requires the board to determine supervision levels based on validated risk and needs assessments.

• Requires the Department of Corrections to assist inmates in obtaining a non-driver identification card prior to release, in conjunction with the Alabama State Law Enforcement Agency.

• Section 1 (supervised release provisions) becomes effective January 31, 2023, contingent upon Director of Finance certification of sufficient appropriations; Section 2 (identification card requirement) becomes effective immediately upon passage.
