HB119 Summary

• Allows retailers licensed to sell beer or wine for off-premises consumption to operate drive-thru, walk-up, or drive-up windows for sales, with employees handling beverages required to be 21 years of age or older.

• Permits licensees with on-premises and/or off-premises consumption licenses to sell alcoholic beverages through curbside pick-up or takeout services for off-premises consumption only, in sealed, unopened containers.

• Sets purchase limits for curbside/takeout sales: liquor limited to 1 liter per customer, table wine to 1,500 milliliters per customer, and beer to 288 ounces per customer, with draft beer allowed only where authorized.

• Requires employees handling pick-up or takeout orders to be 21 years of age or older and verify recipient age; requires licensees to comply with all Title 28 alcoholic beverage laws and Alcoholic Beverage Control Board rules.

• Directs the Alcoholic Beverage Control Board to adopt implementing rules by January 1, 2023; act becomes effective July 1, 2022.
