HB16 Summary

• Provides employees with a private right of action against employers for damages caused by adverse reactions, injuries, or temporary or permanent disabilities resulting from employer-mandated COVID-19 vaccination.

• Allows dependents of deceased employees to sue employers for the employee's death arising from an employer mandate to receive a COVID-19 vaccination.

• Defines COVID-19 as the virus for which Alabama's Governor declared a public health emergency on March 13, 2020, or any mutation resulting in an epidemic with a declared public health state of emergency.

• Applies to all employers in Alabama that employ individuals residing in the state to perform services of any nature.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or upon becoming law.
