HB189 Summary

• Increases minimum service threshold for broadband Internet to at least 100 megabits per second downstream and 20 megabits per second upstream under the Connect Alabama Act of 2021.

• Authorizes the Alabama Digital Expansion Division chief to enter into nondisclosure agreements to protect provider-specific information from public disclosure without express written consent of the service provider.

• Removes the 70 percent funding requirement for last-mile infrastructure in unserved areas, allowing all Connect Alabama Fund revenues to be used for last-mile infrastructure, middle mile programs, and line extension programs after the initial three-year period.

• Permits annual modification of program funding amounts based on recommendations from the Alabama Digital Expansion Division and approval by the Alabama Digital Expansion Authority.

• Becomes effective immediately upon passage and approval by the Governor.
