HB208 Summary

• Creates new crime of aggravated menacing, defined as intentionally placing another person in fear of imminent serious physical injury by use of a firearm or object reasonably perceived as a firearm, classified as a Class C felony.

• Elevates existing menacing crime from Class B misdemeanor to Class A misdemeanor.

• Adds aggravated menacing to the list of offenses constituting domestic violence in the second degree when victim is a current or former spouse, parent, household member, or person with a dating relationship to the defendant.

• Designates aggravated menacing as a violent offense under Section 12-25-32, subjecting it to sentencing guidelines applicable to violent felonies.

• Becomes effective immediately upon passage and gubernatorial approval or upon becoming law by other means.
