HB21 Summary

• Expands the definition of "critical infrastructure" to include pipelines, mining operations, and mining infrastructure in addition to existing facilities such as chemical plants, refineries, power generation facilities, and water treatment facilities.

• Creates a Class C felony offense for damaging, destroying, or breaking critical infrastructure property or interrupting operations during unauthorized entry, increasing penalties from the base Class A misdemeanor.

• Establishes a Class C felony offense for committing unauthorized entry of critical infrastructure while possessing or operating an unmanned aircraft system with an attached weapon, firearm, explosive, destructive device, or ammunition.

• Defines "unmanned aircraft system" as a powered aerial vehicle without a human operator that can fly autonomously or be remotely piloted, excluding satellites and spacecraft.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
