Authorizes Mobile County to assess an additional $10 court cost on each criminal case, including traffic cases, filed in circuit court and district court, excluding juvenile and family court cases.

Requires the court clerk to collect these costs and remit them to the Mobile County Commission for distribution to support the mental health diversionary program.

Directs the Mobile County Commission, in consultation with the assigned judge, to distribute proceeds to the circuit court and district attorney for creation, implementation, and administration of the "mental health court."

Prohibits waiver of the $10 fee unless all other fees, assessments, costs, fines, and charges associated with the case are also waived.

Becomes effective on the first day of the third month following passage and approval by the Governor.
