HB326 Summary

• Defines "loaded firearm" as any pistol, rifle, shotgun, or firearm with cartridges or shells in the chamber, magazine, or both.

• Requires persons who know or should reasonably know a minor child will have access to premises to store loaded firearms in a securely locked box, secure location, or with a trigger lock, with an exception for firearms carried on or near the person.

• Establishes violation of storage requirements as a Class B misdemeanor.

• Makes it a Class C felony if a person fails to properly store a loaded firearm and a minor child subsequently gains access and injures or kills themselves or another person.

• Exempts liability if a minor child obtains the firearm through unlawful entry by another person; becomes effective on the first day of the third month following passage and approval.
