HB477 Summary

• Amends Section 22-27-2 of the Code of Alabama 1975 to define "advanced plastic recycling" as a manufacturing process converting post-use polymers into basic hydrocarbon raw materials, feedstocks, and chemicals through processes including pyrolysis, gasification, depolymerization, and catalytic cracking.

• Specifies that advanced plastic recycling facilities are not considered solid waste processing facilities, solid waste management facilities, materials recovery facilities, waste-to-energy facilities, or incinerators, though they remain subject to department inspections and applicable air, water, and land use regulations.

• Requires advanced plastic recycling facilities to process or transfer at least 75 percent by weight or volume of post-use polymers or recovered feedstocks received during the previous calendar year, or lose their classification and become subject to solid waste laws.

• Defines "mill scale and slag" as co-products from steel manufacturing managed as items of value in controlled manner and excludes them from solid waste definition, provided they do not qualify as hazardous waste.

• Bill becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
