HB71 Summary

• Amends Section 35-8B-3 of Alabama Code to authorize establishment of entertainment districts within certain community development districts where alcoholic beverage sales have been approved.

• Allows patrons of licensed retailers and manufacturers in entertainment districts to carry open containers of alcoholic beverages anywhere within the district boundaries, which may not exceed one-half mile by one-half mile in area.

• Entertainment districts are limited to community development districts formed under Sections 35-8B-1(e) or (f) and are not affected by future municipal annexation.

• Requires district boards to file petitions with municipal or county authorities to hold referendums on alcoholic beverage sales, with elections held at least 82 days after petition filing.

• Becomes effective on the first day of the third month following passage and approval by the Governor, or upon otherwise becoming law.
