HB 9 Summary

• Prohibits the State of Alabama, political subdivisions, and agencies from teaching, instructing, or training employees, contractors, staff, students, or others to adopt or believe "divisive concepts" related to race or sex.

• Defines "divisive concepts" to include nine specific concepts such as claims that one race or sex is inherently superior, that the state is fundamentally racist or sexist, or that individuals bear responsibility for past actions of others based on their race or sex.

• Requires all state contracts entered on or after the effective date to include provisions prohibiting contractors from using workplace training that instills race or sex stereotyping or scapegoating, with noncompliance resulting in contract cancellation, termination, or suspension.

• Mandates the Department of Labor to review all state agency training programs relating to diversity and inclusion for compliance, and requires each state agency head to adopt policies, conduct annual compliance assessments, and designate an employee to ensure compliance.

• Allows discussion of divisive concepts in an objective manner without endorsement as part of academic instruction, and permits diversity and inclusion efforts provided they are consistent with the act's requirements.
