SB112 Summary

• Amends Section 40-12-395 of the Alabama Code to allow new and used motor vehicle dealers to conduct off-site sales at locations other than their permanent business location, subject to specified conditions.

• Limits off-site sales to a maximum of three events per dealer per license year, with each event not exceeding 10 consecutive calendar days.

• Requires dealers to obtain a master off-site sale license (with $25 application fee) at least 10 calendar days before conducting an off-site sale, and separately obtain an off-site sale license for each dealer participating in the sale ($25 fee per dealer per sale).

• Requires dealers to obtain county licenses for off-site locations and display temporary signage identifying the facilitator and participating dealers; all advertisements must be conducted in the facilitator's name.

• Exempts from off-site licensing requirements: temporary vehicle displays at shopping malls or auto shows for advertising purposes only, wholesale sales between licensed dealers, and retail sales at licensed auction company locations.
