SB17 Summary

• Amends Alabama Code Section 13A-7-4.3 to expand the definition of critical infrastructure to include pipelines, mining operations, beneficiation infrastructure, and airports.

• Creates criminal penalties for unauthorized entry into critical infrastructure: Class A misdemeanor for basic trespass violations such as entering enclosed or marked facilities without permission, using fraudulent identification, or remaining after being forbidden.

• Elevates penalty to Class C felony if unauthorized entry involves injury, removal, destruction, or breaking of critical infrastructure property or interference with operations.

• Creates separate Class C felony offense for unauthorized entry while possessing or operating an unmanned aircraft system with an attached weapon, firearm, explosive, destructive device, or ammunition.

• Preserves lawful assembly and peaceful petition rights, including labor disputes, and becomes effective on the first day of the third month following passage and approval.
