SB182 Summary

• Prohibits governmental entities in Alabama from adopting rules, regulations, ordinances, or resolutions that restrict lawful operations of motor fuel retailers or related transportation infrastructure based solely on the type of motor fuel sold, stored, processed, or delivered.

• Defines motor fuel to include all grades of gasoline, gasohol blends, ethanol, diesel, biodiesel, kerosene, aviation fuels, and any other fuel dispensed from on-site tank systems for automobiles.

• Preserves governmental authority to exercise police powers for public safety including building permits, fire codes, and emergency regulations; restrict fuel retailer locations through zoning regulations; and license or permit fuel retailers, provided licenses or permits cannot be denied based solely on fuel type.

• Exempts restrictions under Chapter 17 of Title 40, Code of Alabama 1975 from the prohibition.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
