SB286 Summary

• Adds Section 13A-6-5 to the Code of Alabama 1975 to allow prosecution for any form of criminal homicide if a person's wrongful act causes death, regardless of time elapsed between the act and death.

• Abrogates the common law "year-and-a-day rule" which previously prohibited homicide prosecution if the victim died more than one year and one day after the offender's wrongful act.

• Applies only to acts occurring on or after the effective date of the legislation.

• Becomes effective on the first day of the third month following passage and approval by the Governor.

• Bill is excluded from Amendment 621 constitutional requirements regarding local fund expenditures because it defines a new crime or amends the definition of an existing crime.
