SB301 Summary

• Adds mandatory minimum sentences for individuals in actual possession of a firearm during commission of a crime of violence, Class A or B felony violent offense, or second-degree assault where a firearm was used.

• Establishes sentence minimums of 5 years (basic possession), 7 years (brandished), 10 years (discharged), or 15 years (fully-automatic weapon possession or discharge).

• Increases minimum sentence to 20 years for second or subsequent violations of the firearm possession during crime statute.

• Requires sentences to run consecutive with any other term of imprisonment and prohibits eligibility for probation, community corrections, early release programs, work release, correctional incentive time, or structured sentencing alternatives.

• Becomes effective on the first day of the third month following passage and gubernatorial approval or otherwise becoming law.
