SB313 Summary

• Prohibits public officials and public employees from expending public funds to advocate in favor of or against statewide and local ballot measures, regardless of perceived public purpose.

• Applies to all activities enumerated in Section 17-17-5, Code of Alabama 1975, including distribution of political literature and placement of signs, banners, or posters on governmental property advocating for or against ballot measures.

• Allows objective analysis or factual information about ballot measures that does not advocate a specific position.

• Requires the Department of Examiners of Public Accounts to demand repayment from public officials or employees who violate the prohibition.

• Includes exceptions for trade association dues, campus political discussions at schools and universities, private citizen advocacy outside official duties, general voter participation promotion, municipal referendums, and informing the public about services affected by ad valorem tax passage or renewal.

• Effective January 1, 2023.
