SB35 Summary

• Authorizes consumers to recover the full purchase price plus damages from dealers who sell collectibles falsely represented as authentic, with a 3-year limitation period.

• Applies to autographed items, entertainment media items, historical artifacts, limited edition items, memorabilia, and sports items sold for $50 or more by dealers who have sold 3 or more collectibles in the preceding 12 months.

• Excludes transactions between dealers, barter or trade purchases, and certain pawnbrokers who do not hold themselves out as specialists in autographed collectibles.

• Requires consumers to present substantial evidence to the dealer that the collectible is not authentic before recovery is permitted.

• Allows consumers to file civil actions to enforce rights under this act, and establishes these remedies as supplementary to other legal remedies available under law.
