AL SB53

Creates two new felony crimes: damaging a public monument in the first degree (Class B felony) and damaging a public monument in the second degree (Class C felony).

First degree offense applies when a person with intent to damage property mars, marks, defaces, or damages a monument on public property while participating in a riot, aggravated riot, or unlawful assembly.

Second degree offense applies when a person with intent to damage property mars, marks, defaces, or damages a monument on public property without the participation in riot requirement.

Exempts entities exercising control of public property from these prohibitions and allows for other authorizations under existing law (Section 41-9-235 of Alabama Code).

Becomes effective on the first day of the third month following passage and gubernatorial approval.
