SB64 Summary

• Amends Section 35-8B-3 of the Alabama Code to authorize establishment of entertainment districts within certain community development districts that have approved alcoholic beverage sales.

• Permits entertainment district licensees to allow patrons to exit licensed premises with open containers of alcoholic beverages and consume them anywhere within the entertainment district boundaries, which may not exceed one-half mile by one-half mile in area.

• Allows the Alabama Alcoholic Beverage Control Board to issue entertainment district designations to on-premises retailer licensees and manufacturer licensees conducting tastings or samplings on licensed premises.

• Requires districts seeking to authorize off-premises alcoholic beverage sales to hold a referendum election at least 82 days after petition filing, with municipal or county-wide elections depending on district location.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
