SB68 Summary

• Amends Section 22-34-11 of the Alabama Code to extend loan repayment periods for wastewater treatment facility construction financed by the Alabama Water Pollution Control Authority.

• Allows repayment periods to be extended beyond the standard 20-year maximum when required or permitted under the Federal Clean Water Act, provided the extended period does not exceed the expected design life of the project.

• Clarifies that local governing bodies must establish dedicated revenue sources (including sewer fees, licenses, taxes, special assessments, or other available revenue) to repay loans and cover operation, maintenance, and equipment replacement expenses.

• Requires revenue collections to equal 110 to 125 percent of maximum annual bond debt service, as determined by the authority.

• Became effective immediately upon passage and approval by the Governor (passed Senate February 1, 2022; passed House February 15, 2022).
