SB75 Summary

• Grants probate courts concurrent jurisdiction with circuit courts over all proceedings under Chapter 9 of Title 38 (Adult Protective Services Act of 1976).

• Authorizes probate judges who are members in good standing with the Alabama State Bar to issue elder abuse protection orders as designated by written standing order from the presiding circuit court judge.

• Allows protected persons, interested persons, or parties to remove Adult Protective Services cases from probate court to circuit court by filing a notice of removal and serving all parties, with jurisdiction immediately vesting in circuit court upon completion.

• Updates probate court jurisdiction over minor name changes to include consent requirements from all persons with natural parental or legal rights, with minor consent required if age 14 or older, excluding cases pending in circuit court or involving the Uniform Parentage Act.

• Makes nonsubstantive technical revisions to update code language to current style and becomes effective the first day of the third month following passage and approval.
