SB90 Summary

• Amends Alabama Code Section 13A-6-21 to add a new subsection (8) making it assault in the second degree to intentionally cause physical injury to Department of Human Resources employees or social workers during the performance of their duties.

• Clarifies that off-duty peace officers employed or contracted by private or public entities are considered to be performing lawful duty when working in approved uniform with agency approval, while maintaining no changes to workers compensation classifications or municipal tort liability.

• Expands the definition of assault in the second degree to include attacks on pharmacists, pharmacy technicians, pharmacy interns, pharmacy externs, and pharmacy cashiers, and applies assault protections to home health care workers in private residences.

• Classifies assault in the second degree as a Class C felony.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
