HB107 Summary

• Applies only to Jefferson County and prohibits motor vehicle speed contests, exhibitions of speed, sideshows, burnouts, donuts, and reckless driving maneuvers on public roads, highways, parking facilities, and private property without owner consent.

• Authorizes traffic enforcement officers to tow and impound vehicles for violations for 10 days (first violation), 20 days (second violation), or 30 days (third or subsequent violation) at the registered owner's expense.

• Establishes civil penalty system with district court jurisdiction to adjudicate violations; violators have 15 days from notice to request a hearing and must pay penalties within 10 days of adjudication.

• Persons adjudicated not liable are exempt from towing and storage fees, which must be paid by the governing body employing the traffic enforcement officer; appeals to circuit court available within 14 days.

• Automated photographic and video traffic enforcement systems may be used to detect and record violations; becomes effective the first day of the third month following passage and approval.
