HB284 Summary

• State Forester shall have authority and responsibility to sell vehicles, equipment, and personal property owned by the Alabama Forestry Commission through public auction or negotiated sale to other state departments, agencies, or political subdivisions.

• Public auction sales must be advertised for at least two consecutive weeks on the Alabama Forestry Commission website with property descriptions, inspection dates and times, and auction details; property must be available for inspection during normal business hours for at least 48 hours prior to sale.

• All bids must be publicly taken or opened, with successful and unsuccessful bid records placed on public file; failed bidders may be prohibited from bidding for 12 months; payment is due at time of bid acceptance by cashier's check, bank draft, certified check, currency, or notarized bank letter.

• Purchasers must take possession and remove property within seven days of payment unless otherwise agreed in writing; violations of sale terms subject responsible parties to liquidated damages of $1,000 to $10,000 recoverable by the Attorney General.

• All sale proceeds are deposited into the Alabama Forestry Commission Fund in the State Treasury; the Commission may adopt necessary rules to implement this section; act becomes effective on the first day of the third month following passage and approval.
